The science-fiction vision of a car without a steering wheel or brake pedal has long clashed with the rigid reality of federal automotive regulations. For decades, the Federal Motor Vehicle Safety Standards (FMVSS) have mandated that every passenger vehicle sold in the United States include physical, human-operated controls, regardless of whether a human is actually doing the driving.

Tesla, for instance, has acknowledged using teleoperators to monitor and occasionally move vehicles remotely after incidents.

Philip Koopman, an emeritus professor of electrical and computer engineering at Carnegie Mellon University and a prominent AV safety expert, noted that removing historically unintended restrictions on autonomous vehicles is generally a positive step. "It is appropriate to modify the Federal Motor Vehicle Safety Standards to remove unintended barriers to driverless vehicle deployment," Koopman stated.
Yet Koopman also highlighted a critical regulatory gap: while NHTSA is busy removing legacy rules, there are currently no FMVSS parts that are specific to autonomous vehicle software. "It is long past time to see movement in adding new safety standards relevant to this new technology as well," he warned.
