Understanding the legal root of car dependence shifts the focus from individual consumer choices to structural municipal reform. If cities want to reduce emissions and housing costs, they must dismantle the zoning codes that make dense, walkable neighborhoods illegal to build.

On November 22, 1926, the United States Supreme Court issued a 6-3 ruling in Village of Euclid v. Ambler Realty Co. that fundamentally altered the physical landscape of North America. The decision established that a municipality could legally divide its land into distinct districts, strictly separating single-family homes from apartments, and residential areas from commercial storefronts. While this was a valid concern in the 1920s era of unregulated, polluting industry, the nature of urban employment has fundamentally shifted. Modern commercial uses—like software offices, neighborhood cafes, and retail health clinics—do not emit the toxic byproducts or generate the heavy freight traffic that justified the original Euclid decision. By mandating large minimum lot sizes and banning multi-family housing in high-opportunity neighborhoods, the code artificially restricts housing supply and inflates property values. In 2024, approximately 75 percent of residential land in major US cities remains zoned exclusively for detached single-family homes. This prices lower-income residents out of areas with high-performing schools and robust public services, locking demographic segregation into the municipal map.[4]
