For a local government to charge property owners for rain runoff without triggering a taxpayer revolt or violating state law, one binding constraint must hold: the charge must be legally classified as a user fee, not a tax. If a city defines its ERU at 2,500 square feet, a commercial parking lot measuring 100,000 square feet would be billed for exactly 40 ERUs.
