The fundamental tension at the heart of the Law of Armed Conflict (LOAC) is the friction between the imperative to win and the imperative to preserve humanity. Commanders are tasked with destroying enemy capabilities, yet international humanitarian law (IHL) strictly bounds how that destruction is delivered. Resolving this tension requires a mechanical application of three interlocking principles: military necessity, distinction, and proportionality.[1][6]
These principles do not operate independently; they form a sequential, systemic legal architecture. Before a weapon is fired or a cyber payload is deployed, a proposed action must pass through each of these legal filters. If an operation fails any single test within this matrix, it transitions from a lawful act of war to a violation of international law.[1][8]
Evidence shows that military necessity is frequently misunderstood by the public as a permissive blank check for violence—a justification for any action that hastens victory. In legal reality, it operates as a strict limiting principle. The doctrine permits only the degree and kind of force required to achieve a legitimate military purpose, provided that force is not otherwise prohibited by IHL.[2]
This framework dictates that if a military objective can be achieved by capturing an enemy rather than killing them, or by disabling a facility rather than destroying it, the less destructive option is legally required. Military necessity cannot be invoked to justify actions that violate other fundamental rules of IHL, such as the prohibition against torture or the use of indiscriminate weapons.[2][7]
Once military necessity is established, the targeting calculus moves to the principle of distinction. This serves as the foundational binary of armed conflict: parties must at all times distinguish between combatants and civilians, and between military objectives and civilian objects. Dual-use infrastructure—such as power grids, communication networks, and transportation hubs—serves both military and civilian functions. When distinction is applied to a dual-use target, or when civilians are in the vicinity of a lawful military objective, the principle of proportionality acts as the final legal safeguard. It prohibits attacks expected to cause incidental loss of civilian life or damage to civilian objects that would be excessive in relation to the concrete and direct military advantage anticipated.[4][8]

The "concrete and direct military advantage" is weighed against "incidental civilian harm" by a commander in the fog of war, based on the information available at the time, not by a judge in a courtroom with the benefit of hindsight. This requires a complex, real-time calculation of expected outcomes.[4][7]
The primary limitation of the proportionality principle is the lack of an objective metric. There is no mathematical formula in IHL that equates a specific number of civilian casualties to the destruction of a specific military asset. The legal standard relies on the concept of the "reasonable commander," introducing unavoidable friction into post-strike legal assessments and international accountability.[7][8]
The mechanical application of these principles is no longer limited to kinetic warfare. Legal consensus, as documented by the International Committee of the Red Cross (ICRC), establishes that distinction and proportionality have a direct bearing on cyber operations during armed conflict. The digital domain does not offer an exemption from the laws of war.[5]
A cyber attack that disables a military logistics network but simultaneously cascades into civilian hospital infrastructure must pass the exact same proportionality test as a traditional airstrike. The lack of physical explosive force does not exempt the operation from the requirement to weigh anticipated civilian disruption against military advantage.[5]
The evidence for applying LOAC to cyber operations faces significant technical hurdles. The interconnected nature of civilian and military networks makes it exceptionally difficult for a commander to accurately predict the "incidental civilian harm" of a malware deployment, complicating the proportionality calculus before the operation is launched.[5][9]
Ultimately, the mechanics of LOAC do not promise a bloodless war, nor do they prioritize civilian safety above all other considerations. Instead, they provide a systemic, legally binding framework to prevent gratuitous violence, ensuring that every application of state force remains tethered to a legitimate, defensible military objective.[1][8]
