By September 2023, a rare coalition emerged: the Association of Home Appliance Manufacturers (AHAM) joined forces with energy efficiency advocates, including the Appliance Standards Awareness Project and Earthjustice, to draft a joint consensus agreement. This compromise formed the exact blueprint for the Department of Energy's final rule.[6][7]
The most significant concession in the final regulation is the revised energy limit for gas stoves. Instead of the strict 1.204 million BTU cap, the finalized rule permits gas stoves to consume up to 1.77 million BTUs annually. This adjustment, known in regulatory filings as Trial Standard Level 1, represents the least rigorous efficiency threshold considered by the agency during its environmental modeling.[1][3]
Because of this relaxed threshold, the Department of Energy calculates that 97 percent of gas stove models currently on the market already meet the 2028 standard. Manufacturers will only need to make minor engineering adjustments to the bottom 3 percent of the market's least efficient units. For the vast majority of consumers, the transition will be entirely invisible, with no reduction in available models or brand choices.[1][3]
Crucially for home chefs, the final rule explicitly protects popular premium features that require higher energy outputs. The Department of Energy confirmed that the new standards will not result in the loss of continuous cast-iron grates, which are favored for sliding heavy pots, nor will they prohibit high-input rate burners and specialty wok burners. For electric models, the engineering focus is largely on eliminating standby power waste. Modern smooth-top electric ranges often draw a continuous trickle of electricity to power digital displays, Wi-Fi connectivity, and internal sensors even when the appliance is completely turned off. The new standards force manufacturers to optimize these electronic components to ensure the stove is not needlessly draining power while sitting idle.[3][7]
The legal authority for these regulations stems from the Energy Policy and Conservation Act (EPCA) of 1975. This foundational law requires the Department of Energy to periodically review and update minimum energy efficiency standards for a wide range of consumer products and commercial equipment. Under EPCA, any new standard must be technologically feasible, economically justified, and result in significant energy savings.[2][6]
To implement the consensus agreement, the Department of Energy utilized a procedural mechanism known as a Direct Final Rule. This allows federal agencies to bypass the traditional, lengthy notice-and-comment rulemaking process if they receive a joint proposal from a diverse, representative group of stakeholders. Because manufacturers and environmentalists submitted the plan together, the agency was able to fast-track the regulation into law.[2][8]
Despite the industry consensus, the rule has not entirely escaped legal scrutiny. A coalition of Republican-led states, including Mississippi, Louisiana, and Texas, filed lawsuits challenging the Direct Final Rule. These petitioners argue that the Department of Energy overstepped its authority under the Commerce Clause and EPCA, claiming the incremental standards still disproportionately harm low-income households by raising the upfront manufacturing costs of entry-level appliances.[8][9]

Over the past two years, the Department of Energy has finalized or proposed updated efficiency standards for refrigerators, freezers, clothes washers, dryers, and residential water heaters. The regulations apply exclusively to newly manufactured units built or imported after January 31, 2028. Ultimately, the 2028 cooking appliance standards represent a classic regulatory compromise. Energy advocates secured guaranteed, nationwide reductions in carbon emissions and standby power waste, while manufacturers successfully defended their existing product lines and premium features from heavy-handed redesigns.
