The binding constraint of the United States House of Representatives is that its size is fixed by statute at 435 seats, while the population it represents constantly shifts across 50 states. Because the Constitution guarantees every state at least one representative regardless of population, the remaining 385 seats must be distributed through a zero-sum mathematical mechanism where one state's gain is strictly another state's loss. Following every decennial census, the US Census Bureau is required by Title 2 of the US Code to calculate the apportionment of these seats. As the agency defines it, "Apportionment is the process of dividing the 435 memberships, or seats, in the U.S. House of Representatives among the 50 states." The core challenge is indivisibility: a state cannot receive a fraction of a representative. If seats were distributed by strict population ratios, the resulting fractions would need to be rounded, and different rounding methods systematically favor either large or small states.[2]
Congress debated multiple mathematical approaches for over a century, frequently changing the formula to manage political outcomes. The Hamilton method, used in the 19th century, distributed seats based on the largest remaining population fractions but was susceptible to the "Alabama Paradox," where an increase in the total number of House seats could mathematically cause a state to lose a representative. To eliminate these paradoxes, Congress codified the Method of Equal Proportions in 1941, based on the work of mathematician Edward Huntington and statistician Joseph Hill.[3][4]
The Method of Equal Proportions assigns seats by calculating a "priority value" for every potential seat a state could receive. After each state is assigned its constitutionally mandated first seat, the Census Bureau calculates the priority value for a state's second seat, third seat, and so on. This is done by dividing the state's total apportionment population by the geometric mean of its current and next seat numbers.[1][3]
The geometric mean is the square root of the product of two numbers. For a state moving from one seat to two, the divisor is the square root of 1 multiplied by 2, or approximately 1.414. The state's population is divided by 1.414 to generate the priority value for its second seat. For the third seat, the divisor is the square root of 2 multiplied by 3, which is approximately 2.449.[1]

Once the Census Bureau calculates these priority values for all 50 states up to their maximum potential seats, it places all the values into a single master list and sorts them in descending order. The 51st seat—the first one distributed after the automatic 50—goes to the state with the highest priority value on the list. The 52nd seat goes to the second highest, and the process continues down the list until the 435th seat is assigned.[1][5]
The mathematical objective of the Method of Equal Proportions is to balance representation across jurisdictions of vastly different sizes. According to the American Statistical Association, the objective is to "minimize the relative difference in the number of people per representative." By using the geometric mean rather than the arithmetic mean, the formula ensures that the percentage difference in district sizes across the country is kept as small as mathematically possible, balancing the representation of populous states like California with less populous states like Wyoming.[3][4][6]
The population numbers fed into this formula are not just the resident civilian population. The "apportionment population" includes all residents of the 50 states, plus overseas federal employees—such as military personnel and civilian government workers—and their dependents living with them, who are allocated back to their designated home states. It does not include populations of the District of Columbia or US territories, as they do not receive voting representation in the House.
Because the total number of seats has been capped at 435 since the Apportionment Act of 1929, the priority list creates a hard cutoff. The state that claims the 435th seat secures representation for the next decade, while the state holding the 436th priority value misses out entirely. In the 2020 Census apportionment, Minnesota secured the 435th seat, while New York held the 436th position, missing an additional seat by a razor-thin margin.
Once the Census Bureau delivers the final seat counts to the President, who transmits them to Congress, the federal apportionment phase ends. The process then shifts to the states for redistricting. While apportionment determines how many seats a state receives, redistricting determines where the geographic boundaries of those congressional districts are drawn within the state.[2]
The Method of Equal Proportions is statutory, not constitutional. Congress retains the authority to change the formula or expand the size of the House by passing new legislation. However, because the current method has been in place for over 80 years and any change would immediately transfer political power between specific states, the mathematical mechanism remains a durable, if complex, fixture of American electoral infrastructure.[5][6]
