The Justice Department has charged two former senior FBI officials with lying to Congress about their roles in the 2020 investigation into Hunter Biden's laptop. Nikki Cole Floris, 46, and Bradley Benavides, 56, surrendered to authorities on Friday morning and made their initial appearances in a Washington, D.C., federal court.[1]
Both face a single count of making false statements to the House Judiciary Committee during testimonies delivered in 2023. The charges, brought via a criminal complaint rather than a grand jury indictment, carry a maximum penalty of five years in prison. Magistrate Judge Zia Faruqui released both individuals following the Friday hearing.[1][2]
Faruqui noted their "sparkling backgrounds" in federal law enforcement while acknowledging the unusual nature of charging years-old conduct by complaint. "There is a Sword of Damocles hanging over their head … this will follow them for the rest of their lives," the judge said, scheduling a preliminary hearing for Tuesday.[1][2]
The Foreign Influence Task Force
Floris and Benavides previously held leadership roles in the FBI's Foreign Influence Task Force (FITF), a unit established to counter election interference that the Trump administration disbanded in 2025. Floris served as a deputy assistant director and the functional head of the task force from mid-2019 through mid-2022.[1]
Benavides operated as a section chief from 2019 through the conclusion of the 2020 election cycle. According to the charging affidavit, both officials deliberately obscured their knowledge of the bureau's probes into President Joe Biden's son during their congressional appearances.[1][3]
During a July 19, 2023, committee hearing, Floris testified that she had no involvement in the Hunter Biden investigation. "Did you have any involvement in the Hunter Biden investigation?" Floris was asked, according to the affidavit. "I did not," she replied, claiming she possessed only a high-level understanding.[1][3]
Benavides, testifying before the same committee on September 23, 2023, told lawmakers that he only learned the FBI possessed the laptop by reading a Wikipedia article earlier that year. The Justice Department contends that contemporaneous communications, documentary evidence, and witness accounts directly contradict these claims.[1][3]
Prosecutors assert the two were intimately tied to internal analysis projects focused on potential Russian disinformation surrounding the probe. "In reality, she was in frequent communication with the case team for over a year during which she both sent and received information about Hunter Biden," the affidavit states regarding Floris.[1][3]
The charging documents allege that Floris actively coordinated the FBI's response to news articles about the laptop in real time. Prosecutors claim Benavides was similarly engaged in the matter, asserting that "he was in constant communication about the laptop over a period of days" in the lead-up to the 2020 election.[1][3]
Political timing and pushback
The prosecution marks a rare criminal case against former Justice Department employees and arrives just 10 days before the November midterm elections. Defense attorneys immediately condemned the charges as a partisan maneuver driven by the Trump administration to punish career civil servants.[1]
"Nikki Floris is a patriot. She served our nation as a dedicated FBI intelligence officer for nearly 20 years," her legal team said in a statement released Friday. "Yet today, the [Justice Department] has accused her falsely of a crime on the say-so of politicians, not on the facts."[1]
Floris's attorneys argued that the timing of the arrests reveals their true purpose. "It's no coincidence the government is filing these nonsense charges now, years later, on the eve of an election," the statement continued. Ron Safer, an attorney representing Benavides, urged the court to hold a prompt evidentiary hearing.[1]
Safer questioned whether prosecutors possessed sufficient evidence to charge the "two lifetime public servants." The FBI originally acquired the laptop from a Wilmington, Delaware, computer repair shop on December 9, 2019, and its contents became a central flashpoint in the final weeks of the 2020 presidential race.[1]
Dozens of former U.S. intelligence officials signed a public letter in 2020 stating that the laptop's emergence bore the "classic earmarks of a Russian information operation." The FBI, under then-Director Chris Wray, subsequently backed up assessments that foreign actors were not involved in planting the device.[1]
Internal bureau fallout
The charges align with ongoing efforts by Trump administration appointees to penalize officials involved in investigations targeting the president or his allies. Hunter Biden was ultimately convicted of federal gun and tax offenses before receiving a pardon in Joe Biden's final weeks in office.[1][2]
U.S. Attorney Jeanine Pirro announced the charges on Friday, framing them as a necessary step to restore institutional integrity. "Lying to Congress by anyone strikes at the heart of our democratic system," Pirro said in a statement, emphasizing that no official is above the law.[2]
"When senior FBI agents lie to Congress believing they are above the law, it's time to bring the hammer of justice down on them," Pirro added. She asserted that the officials helped shape the public narrative regarding the laptop right before the election.[2]
FBI Director Kash Patel also celebrated the arrests on social media, claiming the agency had "dismantled the corrupt" squad responsible for the investigations. He accused the former task force of engaging in political weaponization and targeting their opponents.[1]
"As we've said repeatedly: weaponization will never be tolerated at this FBI," Patel stated. He noted that one of the individuals charged is on record privately claiming to be "running a shadow government" during the 2020 cycle, though he did not specify which defendant made the remark.[1]
